The South Korean National Police Agency has announced a legislative preview for a partial amendment to the Enforcement Decree of the Act on the Performance of Duties by Police Officers. This proposed change, part of the standard legislative process, aims to clarify and strengthen police capabilities in border regions, particularly in response to potential security threats and North Korean provocations.
The amendment, following a revision to the main “Act on the Performance of Duties by Police Officers” enacted on December 30, 2025 (and set to take effect on July 1, 2026), empowers police officers and the Korea Coast Guard to restrict certain activities in border areas. Specifically, this includes actions that violate Article 41, Paragraph 1, Subparagraph 1 of the Framework Act on the Management of Disasters and Safety, or Article 127, Paragraph 5 of the Aviation Safety Act. These new powers are designed to ensure the safety of residents in regions near the inter-Korean border.
Under the proposed decree, the National Police Agency Commissioner or the Korea Coast Guard Commissioner will be able to request opinions from relevant central administrative agencies and local government heads when considering restricting such activities. These agencies would then be required to provide their opinions without delay. Furthermore, any police officer who restricts a criminal act or an activity outlined in the newly added provisions will be required to report their actions to their commanding officer.
The government is currently seeking public feedback on this proposed amendment. Interested individuals, organizations, or institutions can submit their opinions until May 20, 2026. Submissions can be made online via the National Participation in Legislation Center (http://opinion.lawmaking.go.kr) or by sending an opinion paper via email (ggkkang@police.go.kr), postal mail, or fax.
