South Korea Launches Major Probe into Corporate Welfare Funds

SEOUL – The Ministry of Employment and Labor (MOEL) announced it will conduct a comprehensive inspection of 5,308 in-company and joint labor welfare fund foundations starting this April. The nationwide crackdown aims to eradicate the misuse of these funds, which are designed to enhance employee welfare and financial stability.

These specialized welfare funds, established by companies (or jointly by multiple companies), are intended solely for the benefit of their employees, covering aspects such as living stability and welfare promotion. However, the Ministry stated that recent investigations have uncovered instances where some foundations have diverted these funds for private use, prompting the need for a thorough review.

The MOEL plans to meticulously examine the settlement documents and articles of incorporation of all operating foundations. This scrutiny will determine if funds have been used for purposes outside their statutory objectives. Any violations identified during the inspection will result in immediate corrective actions, and severe breaches of the law could lead to workplace supervision or even criminal charges, according to the Ministry.

Minister of Employment and Labor, Kim Young-hoon, emphasized the gravity of the situation. “The misuse of in-company and joint labor welfare funds can halt or undermine welfare initiatives, directly affecting the labor welfare of employees, especially those in small and medium-sized enterprises,” he stated. Beyond the immediate inspections, the MOEL is also initiating institutional improvements to strengthen the overall inspection framework, including expanding the scope of legally required submission documents and enhancing inspection criteria.
